LEGAL INFORMATION ABOUT THE CHAMBER

The Official Chamber of Commerce, Industry, Services and Navigation of Barcelona (hereinafter “the Chamber”) is a public law corporation governed by Law 4/2014, of April 1, on the basic regulation of official chambers of commerce, industry, services and navigation, and Law 14/2002, of June 27, on the official chambers of commerce, industry, services and navigation of Catalonia and the General Council of Chambers.

USER ACCEPTANCE

This document (hereinafter referred to as “Legal Notice”) is intended to regulate the use of the various websites owned by the Chamber under different domain names (for example, http://www.cambrabcn.org, www.consultescambra.cat, www.consolatdemar.org, casallotja.com …), and those under its responsibility (for example, www.llotjavirtual.cambrabcn.org) which will be redirected to this Legal Notice.

Any person who accesses this website and uses its services, or provides their data, assumes the role of user, committing to the observance and strict compliance with the provisions herein, as well as any other applicable legal provision.

The acceptance of this document implies that the user:

a) Has read and understands this Legal Notice.

b) Assumes and accepts all the obligations set forth herein.

This Legal Notice will be valid indefinitely or, in any case, will be valid until it is modified.

The provider reserves the right to modify any information that may appear on the website, without any obligation to give prior notice or inform users of such modifications, with the publication on the provider’s website being understood as sufficient.

In this regard, periodic review of this Legal Notice is recommended.

CORRECT USE OF THE WEBSITE

The user agrees to use the website, its contents, and services in accordance with the Law, this Legal Notice, good customs, and public order. Likewise, the user undertakes not to use the website or the services provided through it for unlawful purposes or effects contrary to the content of this Legal Notice, that harm the interests or rights of third parties, or that in any way may damage, disable or deteriorate the website or its services or prevent satisfactory use of the website by other users.

Similarly, the user expressly agrees not to destroy, alter, disable, or otherwise damage the data, programs, electronic documents, and others found on the website.

The user agrees not to obstruct other users’ access to the access service through the mass consumption of computing resources through which the Chamber provides the service, as well as not to perform actions that damage, interrupt, or generate errors in said systems.

The user agrees not to introduce programs, viruses, macros, applets, ActiveX controls, or any other logical device or character sequence that causes or may cause any type of alteration in the Chamber’s or third parties’ computer systems.

The user agrees not to misuse information, messages, graphics, drawings, sound and/or image files, photographs, recordings, software, and, in general, any kind of material accessible through the web or the services it offers.

Except in cases where the Chamber expressly authorizes it, it is not allowed to establish links from third-party portals or websites to web pages of the Chamber, different from the main page of its portal, accessible at the URL address http://www.cambrabcn.org, or the one that replaces it in the future; nor is it allowed to present the Chamber’s web pages or the information they contain under frames, distinctive signs, trademarks, or commercial or social denominations of another person, company, or entity.

INTELLECTUAL AND INDUSTRIAL PROPERTY

This website and all its contents, including texts, documents, photographs, drawings, graphic representations, databases, software, as well as logos, trademarks, trade names, and other distinctive signs, are the property of the Chamber or third parties who have authorized its use.

The website, including, but not limited to, its programming, editing, compilation, and other elements necessary for its operation, designs, logos, photographs, text and/or graphics, are the property of the Chamber or, where applicable, has the license or express authorization from the authors. All the contents of the website are duly protected by intellectual and/or industrial property regulations.

Regardless of the purpose for which the contents were intended, their total or partial reproduction, use, exploitation, distribution, and commercialization, requires prior written authorization from the Chamber. Any use not previously authorized by the Chamber will be considered a serious breach of the author’s intellectual or industrial property rights, as well as the right to privacy and personal image of the persons that may appear.

Designs, logos, texts, photographs, and/or graphics, external to the Chamber and that may appear on the website, belong to their respective owners being themselves responsible for any possible controversy that may arise in respect thereof. In any case, the Chamber has the express and prior authorization from the authors for their publication.

The user and/or visitor to the website undertakes to respect these rights and, consequently, not to copy, reproduce, modify, distribute, transmit, publish, display, or represent any of its contents, without having been previously authorized, expressly and in writing, by the Chamber. Additionally, they commit not to perform any other activity that could infringe the intellectual property rights of the Chamber, collaborators, sponsors, or third parties.

The Chamber may prevent the publication of certain content, or remove it from the portal, if it considers that there may be a violation of current legislation, the rights of third parties, or if it receives any communication to that effect. The aforementioned removal will not give rise to any kind of compensation.

LIABILITY REGIME

a) The Chamber declines any type of responsibility derived from the information published on its website, provided that this information has been manipulated or introduced by a third party unrelated to it.

b) It cannot guarantee that the use made of the website and its services, complies with the law, these general conditions, morality, and public order; however, it will adopt the measures that, at each moment, it considers appropriate, to comply with what is established in the current legislation.

c) It is not responsible for damages or losses, of any nature, that may arise from the incorrect, illegitimate, or illegal use made of the website or the contents offered therein.

d) It reserves the right to prevent the user from accessing and using the services of its web portals, at any time and without prior notice, in case of non-compliance with this Legal Notice and in case of acts contrary to the law, morality, generally accepted good customs, and public order.

e) It reserves the right to modify this legal notice, at any time, respecting the rights acquired by users.

f) Under no circumstances, will the Chamber be responsible for moral damages, lost profits, and/or any direct or indirect damage, that the user may suffer.

g) From the website it is possible to be redirected to third-party content. Since the Chamber cannot always control the content introduced by third parties on its website, it does not assume any responsibility for such content. In any case, it will proceed to the immediate removal of any link that may contravene national or international legislation, morality, or public order, proceeding to the immediate removal of the redirection to the said website, informing the competent authorities of the content in question.

h) This website has been reviewed and tested to ensure it functions correctly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. However, the possibility cannot be ruled out that circumstances may occur, such as programming errors, that cause service interruptions, to perform maintenance tasks, or events beyond its control, such as force majeure, natural disasters, hacker or cracker actions, strikes, or similar circumstances that make access to the website impossible.

DATA PROTECTION

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (“GDPR”) and its implementing regulations, the Chamber informs about the processing of personal data it carries out, both on its website and in the different areas of its activity.

APPLICABLE LEGISLATION AND JUDICIAL JURISDICTION

Any dispute arising from the interpretation or execution of this Legal Notice / Privacy Policy will be interpreted based on Spanish legislation. Likewise, the Chamber and the user, unless prohibited by any regulation, waive any other jurisdiction and submit to the courts and tribunals of the Chamber’s domicile for any dispute that may arise. In the event that the user’s domicile is outside Spain, the Chamber and the user submit to the courts and tribunals of the city of Barcelona.
